Responsible for the implementation of Landlord/Tenant law by providing specialist advise to the asset and property management departments. This role performs an integral role with the implementation of leases and provides ongoing support in the maintenance thereof. In addition to the above, the LA identifies and mitigates legal and compliance risk by providing specialist legal advice, formulating and vetting agreements and ensuring that the company and all properties remains legally compliant by taking external factors and changes to legislation into consideration
Duties & Responsibilities
Provides legal assistance to the Property and Asset Management teams according to agreed parameters with regards to:
Requests for proposals
Asset and Property management agreements
Attends management meetings and provides general legal support to attendees.
Insurance (general admin and claims)
Provides support in the implementation of transactions as and when required.
Coordination of the legal collection process and management of the panel of external attorneys and fees.
Standardisation and updating of all asset and property management template agreements (leases, slas etc)
Drafting of property and asset management agreements and legal assistance with changes made to standard templates (offers, leases, addendums, bank guarantees, surety documents, exhibitions and events agreements.)
Negotiation and drafting of hybrid leases and bespoke leases together with the development and property management teams
Development lease agreements and compliance with TVO / ammortisation requirements.
Standardisation of SLA's with service providers
Ensures all Waterfall DRA and notarial lease requirements are taken into account at lease level.
Manages relationships and agreements with external property legal advisors and monitors duplication of legal efforts Support marketing teams with events / exhibition and ad hoc agreements.
Monitors and research changes in Landlord/Tenant legislation and case law and update templates accordingly.
Identifies training needs applicable to the Asset and Property Management teams as a whole and sources suitable consultants for internal training on an annual basis.
Acts as second line of defense on legislation applicable to the Asset and Property Management teams. Drafting of legal newsletters on topices agreed with Head of Legal
Ensures compliance with relevant Acts.
Controls, manages and governs the processes and systems within the area of accountability to ensure compliance and minimise the business risk.
Implements all audit recommendations in the area of accountability and resolves audit findings timeously.
Designs, approves, implements and maintains policies within area of responsibility.
Desired Experience & Qualification
Legal degree (Bproc/LLB)
Admitted attorney with at least three years post article practical experience within the Landlord/Tenant sector.
Previous experience with Landlord/Tenant law (retail, commercial and industrial).
Understanding and knowledge of the property management life cycle.
