A vacancy exists for a Legal Counsel (Engineering & Construction) to support the team and provide legal advice across their operations within South Africa and Africa.
Duties & Responsibilities
Provision of general legal advice, drafting and vetting of contracts (internal and external).
Knowledge of the standard construction and engineering contracts e.g. Fidic, Procsa, NEC, CESA etc is required.
A good understanding of the South Africa Procurement / Supply Chain process with government clients is advantageous e.g. Bid and Tender processes.
engage and assist proactively and independently with various teams and by means of providing commercially focussed legal advice.
An excellent understanding of the South African Court System and litigation process. E.g. Issuing Summons, Default Judgements etc and general bad debt collections and processes.
Provide litigation support with the representing attorneys to ensure that the Company is represented correctly and professionally at all times.
A good understanding of The Companies Act 2008 as well as King III and IV.
Company Secretary experience is advantageous.
Assist with legal research and day to day activities as and when required.
Desired Experience & Qualification
Minimum qualifications, skills and experience
B degree in Law (LLB) and LLM (Masters).
Admitted Attorney of the High Court / Advocate.
3-5 years post Admission in a corporate environment.
Good understanding of the Engineering & Construction business environment within Africa.
Excellent understanding of Contract law and Corporate governance.
Commercial experience in the following contracting models: Joint Venture / Consortium agreements, Memorandum of Understandings, Sub Consultancy Agreements, Service Level Agreements, Lease Agreements etc.
